s a miracle I received an email yesterday from Vernal Elm !
I answered !
And now a stupid answer from one boss !

Read that !
I think they are not sincere !
They don't explain WHY they never answered to my emails & fax after october
the 8th...
I was never inform that the packet was sent again !
So, how could I search a paquet at customs or postal service ???
It is stupid !
Their total silent a sign of life during 2 month (up to december 2003) can
only make me think that the company was dead or fraudulous !
Am I stupid ?

Rodolphe,

As I've sent in communications (philipctla@yahoo.com perhaps), we sent your
CPUs twice via standard postal express mail. The first time we received
the shipment back stating that you never arranged with French customs to
broker the package for final delivery (duty, brokerage fees, etc.). As you
recall, I offered to update your order per your request and re-ship. We
did this months ago, and I assumed that had finally received the
package. We did receive communication from your US associate, but we
assumed he hadn't been updated on the second shipment.

As you know, we have had a long and successful business relationship (at
least until now), and we are certainly not thieves, nor do we assume that
you are; if you say the chips have not arrived, we believe your statements
and are equally concerned. I'm sorry if there has been a misunderstanding;
we assumed that you had finally received your order.

If you haven't received the package here is what we will do given our
extended relationship, and to demonstrate both our trust in you and our
innocence in this matter:

-Send you replacement chips as per your revised order via UPS Expedited (it
is more expensive, but, at this point, I have no faith in the French Postal
Service). We are willing to absorb the cost of this for now, hoping that
we can recover the original shipment or make an insurance claim.

In return, I ask that you do the following:
-AFTER you receive the chips, contact us immediately so that we know they
arrived and pay only the price of re-shipping (this shouldn't be more than
$50 or so).

-Please investigate with the French postal service and customs to make sure
that they do not have a package lost in their system waiting for action by
you. If you locate the package, please send us back the chips or if you
need them, we can work out another purchase price.

-We did some investigating and noticed that you have made some rather
incriminating and, in our opinion, outlandish (dope?) predictions as to why
you thought we intentionally defrauded you -- in public forums on the
web. I'd ask that once we rectify the situation you issue brief statements
recanting the negative allegations such that our business reputation is not
tarnished due to postal errors over which we have no control.


Anyway, I hope after years of doing business you don't think that we would
steal from you or anyone in the Atari community. To our knowledge, we have
no outstanding customer complaints. If you know of any, please let me
know. Recently, one customer who was publically complaining realized that
the problem was with his credit card company (Discover) and another
realized that the problem was with Paypal not issuing a refund according to
our request.

In fact, we still continue to have some sales to individuals who are likely
your customers, and are happy, and we'd be happy to refer them to you to
verify that we are, in fact, filling orders and satisfying
customers. Please accept our apologies for any damage done to your
business, and let's please put this behind us and re-form the trust that we
once shared.

As a result of all this, we have decided to stop using postal shipping for
French customers as they seem to have an extraordinary rate of error that
reflects poorly upon our business. I guess this is the price we all pay
for trying to choose the cheapest shipping method, and one without
sufficient tracking methods for shipments of high monetary value.

On a more personal note, as Spring arrives, I hope you are well both
personally and professionally and you have my sincere personal regards.

When I asked you the tracking number of the second send I never received an
answer !

Maybe could you tell me know the 2 tracking numbers ??!!

I can't believe your story, sorry...
Maybe you believe it, but in this case there is an other guy behind you that
hides some things to you !!
I send several emails that stayed with no answers from you !
It was total black out after your last email telling me you send again the
packet !
It was october 8th !
AFTER THIS DATE, I received nothing from you !
WHY ?????????

To be clear, I join here the emails I received from you and the emails I
sent you !:

The last from you is 10/08/03 and nothing after !
As you can read, I sent many many emails after !!
Even 3 emails to sales@vernalelm.com, thinking you were maybe not more
working in this company.
But these 3 emals stills with no answers !!!

Please read attentively the emails I sent and you will see I sent the phone
number you asked me and after nothing !

I had no problems with my email account !

So the total absence of answer EVEN BY FAX (I sent one in November 3rd !!)
can only let me think you were a dead company and my money was burnt !
This time I have no 060 here from you and I consider you have 1728 $ to send
back to me !
After this long period of 2 months (from october 8th to december), I decided
to find some other 060 because my customers were cancelling their orders at
me and finding some 060 themselves !
I tried to save my business destroyed by your silent...
I bought the 060 I need yet and lost my money...
Now I do not need any more 060.

If you sent the second time in october, how could you consider after that I
received my packet when I was sending several emails !!!????

Even the connecticut Best Business bureau tried to contact you to find an
arrangment and their never get an answer from you !!
Strange attitude I think ...

Now, if you want I remove my complains in USA and at paypal and stopped some
guys who are looking for you (!), you have to send back my money by paypal
and I will communicate to indicate to everybody that all the story was a
stupid confusion because of some emails problems from you... and that you
are a respectable company that can be used to buy the 060 for the CT60 and
other boards.
and if I produce a third batch of boards I'm agree to order to you again.

As you want...
If the 060 were sent, you have surely a tracking number and you have surely
an insurrance as sender...
Proove me that the packet was sent 2 times...

You told me an address problem !!! Not a problem from me !
And, as usual with all previous package I received from all around the world
(I repair atari main boards), I always received a paper from customs when
they stopped a packet !
I received nothing from them !


As you recall, I offered to update your order [...]
